Abstract

There were two research problems addressed in the research which were (1) What kind of actions could be categorized as body shaming? (2) How was the application of the present criminal law to tackle body shaming? The purposes of this research were to identify what kind of actions could be classified as body shaming and to identify the application of the present criminal law to tackle body shaming. As the research method, the researcher employed normative research method that was based on antinomy of one law and others. The result of this research was kind of actions which could be categorized as body shaming still belonged to general category. Thus, it is expected that in the future there will be further study about types of actions that can be categorized as explicit body shaming to create legal security in the society. Common society do not know that body shaming can be a criminal act. When body shaming is done and it is proved to be a criminal act, it can get the society criminal sanctions which may harm themselves. Therefore the government and law enforcer should take steps actively to give counselling related to body shaming since the action can be classified as a criminal act which is ruled by Criminal Code (KUHP) and Electronic Information and Transaction (ITE) Law.
