Abstract

The Geneva Convention on Refugee Status 1951 an international agreement that binds the parties who ratified it. The United States of America is one of the countries that ratified the Convention, include agreeing to the provisions in article 33 paragraph (1) of the convention, namely about the principle of Non Refoulement. In fact USA did not comply with the provisions in the article 33 paragraph (1). The premise based on the research conducted by normative approach by reviewing literature studies from various sources, both from books, journals, and existing news. Moreover, because of sovereignity over its territory, USA President Donald Trump made a policy to close access to refugees from 7 Moeslem countries, including Libya, Somalia, Yaman, Sudan, Iraq, Iran, and Suriah. Donald Trump made the policy feasible without reason, he made the policy only – for the security of the country he led. The policies regarding refugees delivered in Trump’s presidency include temporary suspension of visas for certain countries, changes in immigration screening, restrictions on refugees, and completing biometric entry-exit systems.
