Abstract

This research is done to know about what are the criteria and juridical consideration that was used by Constitutional Court judges to make a decision about the result problem of President Election in 2009. This research‟s purpose is first, to know about the decision criteria and law considerations of Constitutional Court about the result problem of President Election in 2009 and also to gain the data on the law issues that usually occurs, and then analyze it thoroughly. The method of the research used in this study is a normative law research that is employing the secondary data sources which consist of primary law subject study method and interview which are analyzed in a qualitative way. The result of this research shows that the decision criteria of Constitutional Court divide to two classification. They are formal and material criteria. This research also shows that the decision considerations of Constitutional Court in this case are based on proofs, fact, and evidences from everyone that related to this case. Many problems appeared from this case. Therefore, it can be suggested for KPU, Government, and Constitutional Court for repairing their professionalism then the next election can work better and full of justness
