Abstract
The undergraduate thesis title “potential fulfillment of guarantees by debtors in the provision of working capital loans”. Working capital loans are loans provided by banks to debtor customers who want to develop their business. This thesis was written to find juridical factors haven’t implemented article 8 paragraph (1) Banking law on working capital loans collateral.This thesis research is normative legal research. Normative legal reseacrh is a type of legal research that focuses on secondary data in the form laws and regulations taking into account legal opinions from the banking company. The results show the juridical factors haven’t implemented article 8 paragraph (1) Banking law on working capital loans collateral due to the existence of PBI number 16/11 / PBI / 2014 concerning Macroprudential Control and Supervision which requires the existence of loan to value ratio regulation instruments in macroprudential policies aimed at controlling credit risk. The consequences that will be received by bank if the lack of value of collateral held can cause the position of the bank as a creditor to be weak.
