Abstract

The case of marine pollution that occurs in various parts of the world is an important issue that must be considered by the State. As a result of marine pollution it not only has a negative impact on the animals in the sea, but also has a negative impact on the community, especially people whose living needs come from the sea. The impact of marine pollution is also trans-boundary, where not only the people of one country are affected, the impact also occurs in the territory of other countries. The state government has the obligation to take all necessary measures to ensure that activities carried out by its jurisdiction do not cause pollution to other countries. If the government of that country fails to carry out its obligation not to cause pollution, then the government has responsibility for the consequences of that pollution. There is one legal problem in this research, namely How is the responsibility of the Japanese government for transboundary pollution due to the cargo ship oil spill in the Mauritius Sea? This legal research is normative legal research that focuses on information and data collected through literature study. The conclusion of this study is the Japanese government has a responsibility for trans-boundary pollution caused by cargo ships from Japanese shipping companies leaking and spilling oil in the Mauritius Sea. However, In reality, the responsibility carried out by Japan has not been in accordance with international regulations because until now there has been no follow-up or news regarding the form of responsibility promised by the Japanese government in the form of compensation to Mauritius. Japan should have provided compensation in accordance with what has been promised to Mauritius in order to tackle pollution in the Mauritius Sea.
