Abstract
This research entitled "Legal Analysis of the Application of the Principle of Equality and Certainty of Violations of Money Politics in General Elections and Regional Head Elections according to Law concerning General Elections and Law concerning Elections for Governors, Regents and Mayors." The author found differences in the subject of money politics sanctions and the period of prohibition on money politics in the General Election Law and the Law on Regional Head Elections. The purpose of this research is to analyze the application of the principle of equality and certainty in the Law on General Elections and the Law on Regional Head Elections regarding money politics violations and the reasons for differences in the subject of sanctions and the period of prohibition of money politics. The research method used is normative by collection data through literature studies and interviews. The result of the study are that these two laws have violated the principle of equality and the principle of legal certainty and the differentiation of regulations regarding the subject of sanctions and the period of prohibition of money politics in the General Election Law and the Law on Regional Head Elections are essentially baseless. clear arguments also regarding the different nature of the General Election and Regional Head Election.
