Abstract

The title of the legal research is The PRC's action to turn the artificial island into a military base in the South China Sea Reviewed by UNCLOS 1982. PRC's action by making claims against the South China Sea based on the nine dash line on the map they created, inflict tensions between the PRC and the countries directly bordering the South China Sea, namely Philippines, Vietnam, Brunei and Malaysia. The purpose of this research is to explain the juridical aspects regarding the use of artificial islands in accordance with the International Law of the Sea and the impact on the sovereignty of the Republic of Indonesia for the PRC's actions in using artificial islands as military bases. The research was conducted of normative legal research, research that based on positive legal norms in the form of legislation. The result of the research is PRC's action of making artificial islands as military bases in the South China Sea has violated international law, especially UNCLOS 1982 because in practice the construction of artificial islands aimed at expanding the territory of the PRC. The impact of the PRC's actions on Indonesian sovereignty is the breach of Indonesia's maritime borders, the security of Indonesia's territory in the north is vulnerable, and the surveillance of Indonesia's marine areas using advanced technology in the form of seagliders or marine drones.
