Abstract

Work agreement is beginning of the birth of industrial relations between the capital owner and worker. Lately, many companies used the Work Agreement of Specific Time (PKWT) to press the labourer cost in order to increase profit. But in its practice many application of the Work Agreement of Specific Time’s system was not in accordance with the provisions in Regulations Number 13 Year 2003 about Manpower, so as to damage and eliminate the protection for the worker in the Work Agreement of Specific Time (PKWT) since the taking effect of Regulations Number 13 Year 2003 about Manpower. This research has descriptive analytical with the juridical empirical approach, whereas the data was received trough bibliography research and field work, furthermore the data analysed qualitatively. From the results of this research concluded, the implementation of the protection for the worker Work Agreement of Specific Time, if being carried out in accordance with the available rule, has been gotten adequate protection against the worker Work Agreement of Specific Time, only in its implementation there’s still various obstacles that were caused by lack of rule clarity about the application of the Work Agreement of Specific Time, so as to the deviation towards the application of the implementation of the protection for the worker Work Agreement of Specific Time happened. Hindrances that were dealt with in the implementation of the Work Agreement of Specific Time (PKWT) against the protection giving to the worker including the hindrance that connected to the work agreement, and the last was the supervision hindrance. Solution for the hindrance that linked to unclear regulation, the government should be immediately carried out the improvement towards the worker Work Agreement of Specific Time (PKWT), and for the hindrance that was linked with the work agreement, in order to increase the protection for the worker, government of the work agreement should better make the format of work agreement in more standard manner, for the hindrance that linked with the supervision, each official supervisor should be given the authority to carry out direct action towards the violation that happened to the worker Work Agreement of Specific Time (PKWT) that was done by the company, so as the function of the supervision could give the wary effect to the businessmen who commit violation.
