Abstract

State’s protection in citizen was in principally an obligation of the country. Therefore title of the study that researcher wrote was protection of Indonesian country on citizen who settled in region of United Country Republic Indonesia arrested by Malaysian. Indonesian country had a power ruled at the region. It was also enacted by international law. Basically Indonesia should be able to give a protection to all citizens of Indonesian country. Had Indonesian country’s protection on Indonesian citizen within region of United Country Republic Indonesia who arrested by Malaysian been implemented suitable to legal rule in Indonesia? The writer used a narrative law research model that focused on positive law norms based on data search from literatures related to Indonesian state protection towards its citizens who were in Republic Indonesia sovereignity region whose were arrested by Marine Police Malaysia. Protection that Indonesia gave on citizen was assessed less effective. It could be clearly seen, three observers in Sea and Fishery Resource who arrested by Malaysian were just effort of releasing without presence of responsibility from Malaysian side. Arresting three observer in Sea and Fishery Resource was done in region of Indonesian country by Malaysian.
