Abstract

Online shopping is the activity of purchasing goods and services via the internet. The increasing number of online businesses in Indonesia, coupled with the sophistication of technology that combines online platforms and services and products, certainly brings many advantages and disadvantages for producers, distributors and consumers. The increasing prevalence of online shopping has resulted in the emergence of new problems in the legal field, especially consumer protection law. One of them is the problem of protecting consumer's personal data. So the formulation of the problem in writing this law is "How is the legal protection of the personal data of online shopping consumers". The purpose of this study is to find out how the legal protection of the personal data of consumers who shop online is. The type of research conducted is normative legal research, which focuses on statutory regulations so that the thinking process used is a deductive thinking process. The results of the study show that regulations regarding the protection of personal data in Indonesia are spread across several sectoral settings. The rules governing the protection of personal data are a constitutional obligation of the state as regulated in Article 28G and Article 28J of the 1945 Constitution of the Republic of Indonesia, then regulated in Law Number 8 of 1999 concerning Consumer Protection, Law Number 11 of 2008 concerning Information and Information Technology, Government Regulation Number 71 of 2019 concerning Operation of Electronic Systems and Transactions, Government Regulation Number 80 of 2019 concerning Trading Through Electronic Systems, and Regulation of the Minister of Communication and Information of the Republic of Indonesia Number 20 of 2016 concerning Protection of Personal Data in Electronic Systems.
