Abstract

The title of this legal research is the contractor's responsibility for nonperformance of contract due to construction work not in accordance with the construction work contract. Indonesia is a developing country that is currently facing the era of globalization and the ASEAN economic community. In preparing to compete with other countries, President Joko Widodo prioritized infrastructure development which resulted in a large number of construction works in Indonesia. Problems that arise in construction work include contractors who non-performance of contract. The purpose of this study was to determine the contractor's responsibility for non-performance of contract due to construction work not in accordance with the construction work contract. This research is a normative legal research that requires secondary data to conduct a literature study. The results of the study are as a form of responsibility for contractors who non-performance of contract are required to pay compensation to service users.
