Abstract

One of the land rights is the hitchhike right which is the land right is temporary. In the Special Region of Yogyakarta, the hitchhike right on the land of another person's yard is called Ngindung. The purpose of this research is to know the legal relationship between the landowner and the Ngindung holder if the Ngindung holder built permanent houses and to know the efforts that can be made by the landowner when he want to his land when the Ngindung holder asks for a tukon tali with a large nominal. The type of research used is empirical legal research that focuses on social facts. The data obtained is analyzed qualitatively and drawn conclusions using inductive reasoning methods. The hitchhike right in Kampung Serangan RW.01 consist of RT.01-RT.05, Notoprajan Village, Ngampilan Subdistrict, Yogyakarta City, Yogyakarta Special Region stands on land with the status of property rights to private land. The occurrence of the hitchhike right is because the landowner gives permission to the Ngindung holder to build a building and live on the land without a certain period of time based on the principle of help. In the framework of landowners who want to use their land, then there are efforts made by negotiating with the community of the Ngindung holder and giving tukon tali. There is a legal relationship in the hitchhike right (Ngindung) in Kampung Serangan between the subject of the landowner and the Ngindung holder. In the framework of landowners who want to use his land, then there are efforts made, namely by negotiating with the community of the Ngindung holder.
