Abstract

Entrepreneurs in business label their products with a name as a trademark as a product identity. A trademark is the human intellectuality that’s protected by being registered. Law Number 20 of 2016 concerning Trademarks and Geographical Indications states that one of the scopes of rejection of trademark registration if it meets the elements of similarity in essence. But there are registered marks with elements of similarity. This requires an affirmation of how the criteria of equality are essentially in the terms of the mark and the juridical consequences of potential conflicts occurring in the registration of the same mark. This research uses normative methods that focus on positive law. Based on data analysis, the criteria for similarity of similarities in form, composition, elements, sounds, speech, appearance, class, how to write and layout, writing letters or numbers contained, and colors on the logo. A trademark has similarities is registered under the same name and in the same class is very likely to have a potential conflict which then leads to juridical consequences of trademark cancellation. If a trademark is registered with the same name but in a different class, there is a differentiating, so this minimizes the occurrence of potential conflicts.
