Abstract

In line with technological developments, a digital asset appears. One example of a digital asset is a digital artwork which is then converted into an NFT (Non-Fungible Token) in order to increase the value of rarity, uniqueness, and obtain a certificate of ownership of the artwork. NFT can be traded online through the internet, so that the NFT traded contract can be regulated by the Civil Code and the ITE Law. The problem in this research is how the validity of the NFT traded contract, and when the ownership rights to the NFT assets are transferred from the hands of the seller to the buyer. In this case, the skills of the parties in buying and selling NFT is difficult to identify because the process is carried out online. Another problem is if the NFT works sold through marketplace are objects that are prohibited by law. To be able to answer these problems, researchers used normative legal research methods with secondary data as the main data. In this research, it can be concluded that the requirements for determining the validity of the NFT traded contract according to the Civil Code and the ITE Law are the same in principle. Regarding the determination of the validity of the NFT traded contract, it is subject to paragraph 1320 Civil Code. The ownership rights to the NFT assets pass from the seller to the buyer automatically, when the buyer agrees on the price of the NFT to be purchased. This deal occurs when the buyer presses the checkout button, and confirms the payment in their crypto wallet
