Abstract

Today there has been an armed conflict between Russia and Ukraine. In the armed conflict there are differences in das sein and das solen. The fact is that in the international armed conflict there has been a violation of the Distinction Principle. The type of research used in this study is normative legal research that uses a qualitative method analyses process by comparing the legal regulations of the 1949 Geneva Convention, the 1907 Hague Convention, Additional Protocol I, and Customary International Humanitarian Law which underlies the Distinction Principle to be compared in the situation of facts in the field in the Armed Conflict between Russia and Ukraine. The results found that there has been a violation of the principle of distinction (distinction principle) by means of willful killings towards civilians and indiscriminate attacks Based on the violations mentioned, the Russian State can be sanctioned in the form of: 1. Complain, 2. Compensation, 3. Reprisals, 4. Condemnation of the caught individual.
