Abstract
Legal memorandum titled “The Responsibility of the Government of Indonesia for the Injuries Suffered by Malaysia as the Result of Transboundary Haze Pollution due to Land and/or Forest Fires in Indonesia” is concerning the Haze Pollution occurring in Malaysia in 2019 dan 2023. Indonesia was alleged for causing the Transboundary Haze Pollution as the result of their conducts during that time. This legal memorandum will answer 2 (two) main legal issues. First, whether Malaysia has a legal standing to file a lawsuit against Indonesia before the International Court of Justice. Second, whether Indoenesia is responsible for the injuries suffered by Malaysia. This legal memorandum found that Malaysia has a legal standing to file a lawsuit against Indonesia before the International Court of Justice under 2 (two) grounds, which are obligation Erga Omnes and Diplomatic Protection. This legal memorandum also found that Indonesia shall be held responsible for the injuries suffered by Malaysia under the grounds that Indonesia violated ASEAN Agreement on Transboundary Haze Pollution and its other obligations International Environmental Law and Human Rights norms and principles. For that reason, Indonesia is under the obligation to do reparation for the injuries suffered by Malaysia.
