Abstract

Unaccompanied refugee children are children who are separated from their parents and are not under the care of adults who are legally responsible for them. Unaccompanied refugee children also have the right to protection of their rights stated in the Convention on the Rights of the Child. Indonesia as one of the participating countries that has ratified the Convention on the Rights of the Child must protect unaccompanied refugee children who are a vulnerable group who become victims of criminal acts such as human trafficking, child exploitation and sexual abuse due to the absence of adults to protect them. The protection provided is the same protection as other refugee children in accordance with one of the principles of the Convention on the Rights of the Child, namely non-discrimination. Therefore, this research aims to find out and explain the forms of protection for unaccompanied refugee children in Indonesia based on the Convention on the Rights of the Child. The research method used is normative research which uses literature study and is also supported by interviews with related sources. The result is that Indonesia is still relatively weak and not yet optimal in providing and guaranteeing protection for the rights of refugee children, especially unaccompanied refugee children, because there are still several obstacles that Indonesia is experiencing, one of which is that there is still no strong legal basis regarding procedures for providing protection to unaccompanied refugee children. assistance caused by Indonesia not having acceded to the 1951 Geneva Convention and the 1967 New York Protocol as well as the absence of procedural articles in the Convention on the Rights of the Child regarding the provision of protection to unaccompanied refugee children.
