Abstract

Commercial mineral mining activities in space have become an important topic in international legal studies, given the potential abundance of space resources and the increasing interest in their exploitation. This research aims to analyze aspects of international law related to commercial mining of minerals in space. The research method used is analysis of international legal documents, including relevant treaties and conventions, as well as the latest legal literature. The results of the analysis highlight issue such as property rights, jurisdiction, environmental responsibilities, and the regulatory framework needed to regulate mining activities in space. In addition, this research also evaluates the role of international bodies such as the United Nations in managing space resources sustainably. It is recommended that there be an amendment from Outer Space Treaty 1967 or even the creation of new regulations for activities such as exploration and exploitation, especially regarding commercialization, can be implemented well and in line with the spirit of international legal principles. The conclusion is regulation of commercial mining activities in space from each mining country has not complied with the international law, because these mining countries occupy ownership rights of outer space resources are the rights of the state, which is contrary to Common Heritage of Mankind principle.
