Abstract

This study with the title of The Role of Traditional Chief in the Settlement of Customary Land Disputes among Wombonda Tribe to Achieve Legal Assurance in SupioriRegency, Papua Province.The purpose of the study is to find out analyze the role of traditional chief in the settlement of customary land dispute among Wombonda tribe to achieve legal assurance in SupioriRegency, Papua Province. The study was conducted by a normative legal method using literatures or secondary data. Primary legal materials include regulations, while secondary legal materials provide explanation on the primary legal materials. The primary legal materials were legal opinions and non-legal materials from literatureand opinions from informants on the role of traditional chief in the settlement of customary land disputes. Data were collected through interview and literature study. Data analysis was done to make description, systematization, analysis, interpretationand positive legal assessment. Based on the results of the study, it can be concluded that in the context of Wombonda tribe’s life, customary land disputes were usually settled by traditional chief (manawir).The role of traditional chief is to keep harmony in a social life. The traditional chief (mananwir)serves to accept, execute, and improve the norms violated in terms of recovering the image of customary law.Legal assurance in the settlement of customary land disputes provided by the traditional chief is based on acts, customary legal norms, and decisions issued by the traditional chief with an ultimate authority making them the binding customary norms.
