Abstract

Illegal fishing is an illegal fishing activity or a fishing activity carried out contrary to the provisions of laws and regulations in the fisheries sector. One example of an issue that has attracted attention and is still occurring in the Indonesian region, an example of illegal fishing is the illegal fishing in the Malacca Strait. The rise in these cases is due to the sanctions being enforced less firmly and less effectively. This research aims to determine law enforcement against foreign vessels carrying out illegal fishing in the waters of the Malacca Strait and to determine the inhibiting factors in dealing with illegal fishing that occurs in the Malacca Strait. The method used in this research is empirical juridical research. The approach taken in this research uses descriptive analysis which leads to normative legal research. Data collection techniques were carried out in two ways, the first was library research and the second was field research the means of interviews with related parties. The research results show that law enforcement against foreign vessels carrying out illegal fishing in the waters the Malacca Strait is based on Law Number 45 of 2009 concerning Amendments to Law Number 31 the 2004 concerning Fisheries.
