Abstract

This research aims to determine and analyze the form of the judge's consideration of the evidence carried out by the judge who was accused by judex factie in Decision Number: 45/Pid.B/2020/PN.Olm and the manifestation of material truth in the judge's decision in judex factie. The legal problem or legal issue that is the subject of discussion in this research is the judge's consideration of the evidence presented by the public prosecutor in the judex factie case and the material truth of the judge's consideration in the judex factie case. The aim of this research is to determine and analyze the form of consideration by the judge in the judex factie court regarding the rape committed by the defendant and the realization of material truth in the judex factie judge's consideration which can impose a crime. The research method that the author uses is normative research which refers to legal norms contained in statutory regulations. Based on the research results of the Study of Decision Number: 45/Pid.B/2020/PN.Olm and Decision Number 992/K.Pid/2020, the panel of judges' considerations were based on the facts at the trial where these facts were relevant to the witness' testimony - existing witnesses. The material truth in judex factie is based on evidence linked to witnesses regarding the panel of judges' inability to decide the case.
