Abstract

The phenomenon of international refugees is a global problem. Indonesia is not yet bound by international instruments related to refugees, either the 1951 Geneva Convention or the 1967 New York Protocol. On the basis of humanity, Indonesia has accepted refugees from abroad who come to Indonesia since 1975, until now there has been no regulation that specifically regulates the handling of refugees from abroad. Until finally Indonesia made Presidential Regulation Number 125 of 2016 concerning Handling Refugees from abroad. After conducting research, the attitude taken by Indonesia to accept refugees from abroad is very good, but in terms of fulfilling the rights of refugees there are still gaps. This research uses normative research methods by placing the law as a building system of norms related to principles, laws and regulations, court decisions, agreements, doctrines. The results obtained from this study are the implementation of the fulfillment of refugee rights Presidential Regulation Number 125 of 2016 is considered not going well. It can be seen from the non-fulfillment of refugee rights stipulated in the 1951 Geneva Convention and the 1967 New York Protocol.
