Abstract
This overlapping land dispute is a land problem where more than one plot of land is issued with overlapping certificates in whole or in part. This research aims to provide legal certainty for the community. The resolution that can be made to overlapping land disputes in Merangin Regency is with the Merangin Regency Land Office in accordance with the function of the Land Office to control and handle land disputes. The land office in resolving overlapping land in Merangin district, is in accordance with the Ministerial Regulations of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases. in paragraph 6, there are 7 stages for resolving land disputes, but in article 6 paragraph (3) it can exclude these 7 stages, if the case classifier is medium and light, so that the Merangin district Land Office, classifies overlapping cases as mild cases and Sendang, leaving aside the 7 stages, becomes 4 stages, namely, case study, research, exposure of research results and case resolution. The method used in this research is empirical legal research. In the rules for resolving land disputes as regulated in (Ministerial Regulation Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land.
