Abstract

Airline passengers experience many problems during flights, including lost and damaged checked baggage. This is very detrimental to passengers because it takes up time, energy and even financial losses. So this paper is made to find out the responsibilities and procedures for airline compensation to passengers for handling lost and damaged checked baggage. Data collection techniques are carried out by interviewing sources, literature study and data analysis. As long as the checked baggage is under the supervision of the carrier, if it is found lost or damaged, the carrier is fully responsible, this has been applied in Article 2 letter C of the Minister of Transportation Regulation No. 77 of 2011. The carrier implements the principle of presumption of liability, which means that the carrier is considered guilty, if the carrier can prove himself not guilty then released from responsibility. The carrier in handling damaged checked baggage will check first to classify the damage as major or minor. As for lost checked baggage, the carrier will search by tracking using email and CCTV. The results of this research conclude that legal protection for missing and damaged checked baggage is considered not fair enough for passengers judging by the amount of compensation.
