Abstract

This legal research discusses copyright infringement of the song "Halo-Halo Bandung" by Ismail Marzuki which was modified by the YouTube channel Lagu Kanak TV without permission from the rights holder. This violation was committed by a foreigner, even though copyright law in Indonesia is territorial. This research uses normative legal research methods which focus on statutory regulations.The results of this research indicate that the rights holder for the song "Halo-Halo Bandung" can submit a request for deletion under YouTube's terms and conditions. YouTube itself cannot be sued legally because it considers that all channels do not violate copyright and has facilitated the efforts that can be taken if copyright infringement occurs. Furthermore,The Indonesian government can represent the rights holder by mediating through WIPO or making a settlement in Malaysia in accordance with Malaysian law because the YouTube channel Lagu Kanak TV is domiciled in Malaysia. The author concludes that YouTube can wait for a report from the rights holder for the song "Halo-Halo Bandung" and delete the upload from the Lagu Kanak TV channel. In addition, the Indonesian government can represent the interests of the rights holders of this song through WIPO mediation efforts or making a settlement in Malaysia.
