Abstract

Since its establishment by the Indonesian government in 2020, the Indonesian Migrant Workers Protection Agency (BP2MI) has routinely received reports of complaints or problems that occur when these crew members work as crew on vessels. Most of them are human rights violations, one of which is the focus of the author's research, the case of exploitation that occurred on the Long Xing 629 vessel. Exploitation practices that occur include physical violence, discrimination, forced labor, human trafficking and others. This research then focuses on how the legal protection of Indonesian crew members by the Indonesian Government based on the Maritime Labor Convention 2006 in a case study of the exploitation of Indonesian crew members on the Long Xing 629 vessel in 2020. The research method used is normative research, by focusing on positive law, especially international legal instrumens related to this research, complemented by literature studies and supported by literature related to this research. Based on analysis, it concluded that there were cases of human rights violations against Indonesian crew members. However, Indonesia has also made an effort to protect the crew by criminalizing the actors who committed violations on the Long Xing 629 vessel. Therefore, the author suggests to further emphasize integration related to state institutions authorized to regulate human rights protection, the Indonesian Government is also recommended to ratify ILO Convention No. 188 concerning Work in Fishing, establish bilateral relations with the Chinese Government, and several other suggestions to relevant international institutions.
