Abstract

ABSTRACT The usage of Mercenaries in armed conflicts have increased significantly over the years, and Russia’s invasion of Ukraine involves heavy reliance on the usage of Russia’s state owned private military company, the Wagner Group. With the atrocities committed by members of the Wagner Group in a village in Ukraine, this research aims to analyze aspects of International Humanitarian Law in regards to the legality of the usage of mercenaries in armed conflicts, as well as the ‘state responsibility’ in regards to the atrocities committed in Ukraine by the Wagner Group. The research method used in this research involves analyzing legal documents such as conventions, treaties, articles, as well as using relevant legal literature. The result of the analysis highlights issues such as the lack of any strict and precise law regulating the use of mercenaries in armed conflicts. Additionally, this research also highlights the scope of ‘state responsibility’ in the case of the atrocities committed by the Wagner Group in Ukraine . This research has concluded that Russia did not violate international law by utilizing the Wagner Group in its invasion of Ukraine. This research also concluded that the atrocities committed by the Wagner Group must be attributed to Russia, as they were acting as organs of the State of Russia in accordance to ARSIWA (2001).
