Abstract

Land is a strategic natural resource that is important for human survival. The government needs to regulate the use of land to achieve people's welfare. Land rights have a social function and development cannot be separated from the availability of land. This includes the construction of the NYIA airport itself. The construction of NYIA Airport affected six villages and 550 families had to be relocated. The victims asked for compensation and justice based on Article 36 of Law No. 2 Year 2012. Land Registration provides legal certainty over land rights. So further in this study will be analyzed related to what form of compensation obtained by residents due to the construction of the airport, and whether it is in accordance with the relevant regulations and laws? what are the mechanisms of settlement / legal protection obtained for victims who are still affected by the construction of the NYIA Kulon Progo airport? It was found that residents affected by the construction of NYIA Airport in Yogyakarta were dissatisfied with the land acquisition process and the compensation provided, and there were concerns about the effectiveness of land dispute resolution and compensation schemes regulated in the law, so the importance of the principle of openness or transparency in the implementation of compensation, especially for the loss value.
