Abstract
One of the biggest refugee crises in Europe occurred in Greece and sparked resistance through pushback practice and violating the principle of non refoulement. This research aims to explain the responsibility of the Greece in carrying out its responsibilities for violations its non-refoulement obligations towards Afghan refugees.This research is normative legal research by analyzing statutory regulations related to the topic of this research, and supported by data obtained from interviews with sources from the Head of International Law Department, Gadjah Mada University. The source of legal material used is based on the 1951 Geneva Convention concerning the Status of Refugees and the principle of non-refoulement. Then analyzed using deductive analysis techniques. The results of the research show that the principle of non-refoulement has been considered as customary international law through existing practices so that the principle of non- refoulement is binding on countries and Greece is responsible for the actions taken against Afghan refugees under ARSIWA framework and ECtHR decisions.
