Abstract

The rapid advancement of technology has encouraged the emergence of digital- based jobs such as freelancer gig economy websites, which allow individuals to work independently, freely and flexibly. Unfortunately, there are still many freelancers who question their legal relationships with providers and clients whether they are subject to the KUH Perdata (Indonesian Civil Code) or Labor Law. The purpose of this research is to analyze how the legal relationship between the parties involved and then also analyze how legal protection for freelancers if the payment is not fulfilled. The benefit of this research is to provide an overview of the legal relationship between freelancers with providers and clients and provide a reference for freelancers whose payments are not fulfilled. This type of research is juridical normative by means of literature studies. The result of this research is that the legal relationship between freelancers with providers and clients in the gig economy website is born due to certain service agreements in accordance with the KUH Perdata (Indonesian Civil Code) so that legal protection that can be taken also refers to the mechanism for resolving default of an agreement.
