Abstract

The issue of legal protection for workers against workplace harassment in Indonesia remains a challenge, as the existing labour laws do not specifically address this issue. Although the 1945 Constitution and the Labour Law regulate discrimination, provisions regarding workplace harassment are still limited, and ILO Convention No. 190 has yet to be ratified. This study aims to analyse the legal framework of labour law and the measures that workers can take in addressing cases of workplace harassment at PT BS. The research method used is normative, utilizing primary legal materials in the form of relevant legislation and secondary legal materials including books, journals, research reports, newspapers, authentic documents, and statistical data released by official institutions, as well as general dictionaries. Also strengthens the analyse through interviews with relevant sources related to this legal writing topic. The conclusion of this research indicates that the existing legal protection is still inadequate, and concrete steps are needed, such as the ratification of ILO Convention No. 190, regulations in the Collective Labor Agreement, and increased awareness among workers to report acts of harassment. Thus, it is hoped that a safer and more comfortable working environment can be created for all workers.
