Abstract

Traffic accident of shuttle bus be one of the problem in the transportation of people. The liability appears from that traffic accident for the carrier. Not certainly regulated about the amount of compensation for the passenger, besides there are many illegal compannies that operating arround. For that reasons sometimes the passengers did not get the compensation for their losses. This thesis is get to know about the liability and legal certainty of the compensation for passenger’s losses. This thesis using a normative method by the library research and data analysis. The liability if the traffic accident of travel happened is lay on the company and the driver. Nevertheles, the compensation for passanger’s losses is not the driver’s liability but it’s the company’s liability according to the Article 191 UULLAJ. According to the Article 192 Paragraph (1) UULLAJ the liability principle based on presumption of liability principle. This Article become a general principle that obliges the travel company to compensate the passenger’s losses. Furthermore, the liability could regulated by the clause each of the contract of carriage. There is no legal certainly about the amount of compensation for losses, so the companny could make their own contract clause. If the case brought to a court, the judge has a responsibility to provide justice.
