Abstract

The Indonesian Constitution mandates that Regional Head Elections be conducted democratically. Through the Law on Regional Head Elections, democracy as mandated by the constitution is defined as the way elections are conducted directly and democratically. Democracy according to Robert A. Dahl's theory includes two main elements, namely the level of participation and competition. The existence of a single candidate in the Regional Head Election continues to increase every year it is held. The purpose of this study is to determine and analyze the constitutionality of a single candidate in the Regional Head Election and its consequences for the realization of democracy in Indonesia. The type of research used is normative legal research using primary legal materials and secondary legal materials. The data is analyzed qualitatively. The results showed that a single candidate in the Regional Head Election is constitutionally valid because it is in line with the constitution which mandates democratic elections based on democratic measures according to Robert A. Dahl's theory which includes the level of competition and participation even though it is less perfectly realized. A single candidate in the Regional Head Election has consequences for decreased voter participation, reduced democratic quality, and the impact of further regional governance if led by an appointed Regional Administrator due to an empty column wins or otherwise won by a single candidate.
