Abstract

Discrimination of worker females on the occupation promotion is still often happened in companies, although not in as great as those in former time. Anything the reason of the existence of discrimination, this matter can not be perceived as true because it has been ruled in legislation, in particularly on female and working field. In occupational field, it can not be denied if current time females are still perceived as trivial on their capability in work in particularly on occupation of a company. The purpose of this research was to find out the causes leading to the discrimination between the female workers rights and male workers right on the occupation and for finding out the shape of discrimination toward the female workers' right on their occupation. In this legal research of this legal writing used normative research method that based on the data collection from literatures relating to the discrimination to the female workers on occupation promotion juridically, i.e. through prevailing regulations. The result of the research conducted by author is that there is not discrimination toward female workers on occupation promotion in PT. DML (Dua Mitra Langgeng), although contains bias gender because females are perceived based on their femininity, instead of their working quality. Meanwhile in Worker and Transmigration Institution of Bantul Regency there is discrimination, i.e. non-balance in occupation position between female staff and male staff because there are more males. The reasons are females perceived incapable to conduct overtime job and males are perceived more competent for the job directly relating to society. In fact females and males have equal rights. The suggestion from the author is that society hopefully can perceive females as equal to male in the terms of job, thus female workers are not perceived trivial as weak group in conducting their working activities by the reason of their faith as women and ultimately discrimination to the female workers on occupation promotion is not necessary to happen.
