Abstract

Education right is one of the rights, which necessary for the growth of human being. Education rights as human being rights, is the fundamental rights, which is to protect and also support other rights. This thesis aims to analyze implications problems of International Covenant on Economic, Social, and Cultural Rights ratification towards policy of Indonesian government in education rights. This research uses normative method to study and analyze the International Covenant on Economic, Social, and Cultural Rights, which relate to policy of Indonesian government in education rights. The result of the analysis and process is obtained by qualitative method, from which a conclusion is made using deductive thinking method. In fact, Indonesian government has acknowledged human rights since establishment of the Constitution 1945, which now completed with fourth amandements of the Constitution 1945, was later applied on regulation of National Education System. After government ratified this International Covenant on Economic, Social, and Cultural Rights, it implicates the policy of Indonesian government will influence the implementation of education rights. This implication is shown in some cases, as obligation of state, for example: in striving for free education; law and regulation synchronization; developing international collaboration; maximizing available resources; making annual reports; assuring freediscrimination execution; specifying effective and transparent system; respecting, protecting, and fulfilling "essential features"; specifying minimum education standard, and executing "minimum core obligation". The conclusion of this thesis, that is the government would like to promote the education rights as one of the important human rights. Even though, until now the government is not yet perfect to fullfill of the ideal on education rights. The government would promote education rights to get 20 percentage of General Revenues and Expenditure Budget, so we hope that the respect of education rights will be implicated to the growth of Indonesian people in education.
