Abstract

The development of Economy and Business has caused the new development in the sector of law, the concrete proof of a law development in the sector of economy is the establishment of some guarantee institutions such as Fidusia arranged in The Law number 24, 1999 caused by the demand of people's need so many people or law institutions which guarantee the things belong to them included the one of salary usages for the staff in Caritas cooperation as the guarantee on credit with the construction of Fidusia. Therefore in the research of law or the writing to get an university degree, the writer tried to research could the salary usage as the guarantee on credit was allowed by the law. That would be analyzed based on the guarantee object of Fidusia as the mention in The Law number 24, 1999 or toward the law of thing occurred. Through the research, it was also expected to give the data of jurisdiction as a picture later or measurement for the solution of law issues concerning the guarantee object of Fidusia especially concerning the salary usage of staff as the guarantee of credit.The type of research used was the normative law research namely the law material focused on norm by requiring the secondary data. It was the law material as the main data and the method of collecting data through the literature study and interview and the data analysis using the analysis in quantitative. The result of research in fact namely the usage of salary as the guarantee object of Fidusia could be allowed by the law because it was the unreal thing which was the right of bill or accounts. The suggestion of writer was in order that it was need a special chapter concerning the guarantee object of Fidusia in the Law of Fidusia Guarantee. For the institution of government especially the Law and Human Right Department in order to be as soon as to give a related decision to the problem in the salary usage of staff as the guarantee object with the construction of Fidusia so it could give a certainty of law for people and it could answer the need and development of people and for people in order to be an obligation to register the thing which became the guarantee object of Fidusia in order to have the strength of law.
