Abstract

The title of this study is “ASEAN Role in Overcoming the Conflict Between the People's Republic of China (PRC) with ASEAN Member Countries in Relevant to People’s Republic of China (PRC) Claimants on the Whole Waters Area of South China Sea”. The purpose of this study was to determine the role of ASEAN in conflict resolution efforts in the South China Sea. This research is a normative legal research that focuses on secondary data that serve as the primary legal materials consisting of primary legal materials, legal materials secondary, and tertiary legal materials. In this study data collection is done by using library research methods, namely by reviewing the legal materials which concerned with the problems in this study, as well as interviews with various sources, which held a question and answer orally with resource persons to obtain more in-depth explanations and information on matters relating to the issues discussed in this study. The data obtained from the literature and field, both orally and in writing, then discussed and given an explanation, and then concluded with the deductive method, which was to draw conclusions from the general to the specific. In conclusion, territorial conflicts that occurred in the South China Sea is increasingly difficult to resolve due to the PRC government's attitude often inconsistent towards the conflict resolution efforts offered by ASEAN. ASEAN countries still have not reached agreement on a Code of Conduct (COC) due to the different interests of each country. ASEAN is expected to face the conflict’s dynamics while maintaining peace and turn conflict potential into cooperation potential through a number of potential peace talks.
