Abstract

The main topic of this thesis, the author discusses the legal protection for people who experienced a traffic accident caused by damaged roads. Background of this research based on the traffic accident caused by damaged roads, where the accident often happened to all the people especially when they used motorcycle. Main issues in this research are, the rules of law are might be used to provide legal protection against people had an accident that becomes from the damaged road, and the factor that becoming an obstacle to provide legal protection for traffic accident victims. Method approach in this research used nornative law, this research focused on norms law and secondary data as the main databank and used primary data for support it. Data sources in this research is reached by literature review and field studies. Both data is process by using qualitative analysis. By virtue of analysis that has been done by the author, so inconclusive as follows: rules of law provide legal protection against road users had an accident by damaged road is “ Undang-Undang Dasar 1945 ”, And “ Undang-Undang Nomor 22 Tahun 2009 ” about traffic and public transport, and constraints in providing legal protection for victims of traffic accidents was the lack number members of the police, less number of facilities that supporting the police activity , and low of awareness by victims to inform the accident for legal protection by the government.
