Abstract

The tittle of this research, the fulfillment the right of client not to get physical severity in the process of investigation in Yogyakarta Police Resort. The purpose of this research wants to know the cause or factor why the fulfillment the right of client not to get the physical severity in the process of investigation in the level of investigator is not yet fulfilled optimaly. The kind of research done is the normative law research which focuses on positive law norm in the form of legislation regulation with the method collecting data through library study and interview. This research was done in the police resort of Yogyakarta, especially on investigator part ( public criminal investigator ). The result of research shows that the physical severity is still done by investigator to the client in the form of beating by using hand, leg or blunt thing. This happened because there are several factors which make investigator side having no choice, such as try to escape when to be arrest, no honest in giving the information, and also because of the physical against done by client to investigator.
