Abstract

Thesis titled "Legal Protection for the Curator of Implementation Management and Treasure Settlement in Bankruptcy ", with the formulation of the problem is whether Act No. 37 of 2004 on Bankruptcy and Suspension of Payment has been providing legal protection for the Receiver. The research objective is to investigate and analyze whether the Law No. 37 of 2004 on Bankruptcy and Suspension of Payment has been providing legal protection to carry out the maintenance and curator in the bankruptcy estate settlement. This type of research used in writing this essay is a kind of normative legal research, the research uses the study and analysis of legislation on bankruptcy and suspension of debt payments. Normative legal research using secondary data consists of primary legal materials and secondary law. Then, analyzed using primary legal materials and secondary law and the process of deductive reasoning. Results of the study is that the Receiver in carrying out the maintenance and property settlement the debtor bankrupt, have not received legal protection of Law No. 37 of 2004 on Bankruptcy and Suspension of Payment. This occurs because the bankruptcy laws there are inconsistencies between several articles including Articles 9 and 16. Then, the control functions of the supervisory judge to be more optimized in order to protect the curator.
