Abstract

This research was entitled “The Implementation of labor’s social insurance of BPJS work accident program for worker at PO.PANSA bus company”. This research aimed to know the implementation of the social security workers and the obstacle factors of BPJS Work Accident Program that were not implemented to the PO.PANSA workers. This research was an empirical law research. It was done to the respondent directly as the primary data which was also supported by the secondary data. The data were analyzed with the qualitative method. Therefore, the researcher gained the depiction of the problem. Based on the data, the researcher found that PO.PANSA did not implement its obligation to the workers. The company did not engage the workers to BPJS Employment which has been mandated in article 15 paragraph (1) of Law No. 24 of 2011 about Badan Penyeleneggara Jaminan Sosial. Furthermore, the researcher found that the first obstacle of the unimplemented BPJS Employment in the company was caused by the entrepreneur who avoids facing the same difficulty with the other users of BPJS of health. Second, the company had no legal entity yet; therefore the company could not give the social security formally.
