Abstract

This legal writing entitled Discretion of Police in Management of Underage as Perpetrator of Psychotropic Crime. In Indonesia there was born some regulations intended to protect the necessities of children either as the perpetrator or as the victim of crime. However the total of crime conducted by children in six big cities rapidly increase. There are some reasons for underage to conduct crime. Some of them is behavior of their parents that often do violence towards their underage. Other reason of the fluctuation of total of crime conducted by underage is the spillover of value system in family, school and society. Some of these value system clashs one to antoher and confuse to someone who grow into adultness. The next reason is the degradation of social rewards towards underage and teengers. The purpose of this research was to know criteria of implementation of discretion of police towards the underage as perpetrator of psychotropic crime and to knokw the barriers faced in the implementation of discretion of police towards the underage as perpetrator of psychotropic crime. Poverty in their social environment is also causes. Type of research used in this research was normative legal research, i.e. a research focused on norm and this research needs secondary data as primary data. Based on result of research and discussion conducted, the criteria of implementation of discretion of police towards underage as perpetrator of psychotropic misuse are, the underage for the first time conducted psychotropic misuse, the underage are still in productive age, and parents or representative of the children are still able to teach and care of the children better and the barriers faced in the implementation of discretion of police towards the underage as perpetrator in psychotropic misuse is very difficult to conduct transfer action towards the management of underage case, human resources owned by Underage Socialization Institution of Yogyakarta are still lack, in addition there is unavailable cooperation between Police, Underage Socialization Institution, and Non-Government Organization.
