Abstract
The title of this law study is Legal Protection for Brand Owners in Preventing Distribution of Counterfeit Goods. This study aims to obtain, understand, and analyze the juridical factors which cause the Distribution of counterfeit goods to the community and how governments and brand owners can prevent counterfeit goods. The methods in this study use a normative approach that is juridical normative approach, meaning that legal research focuses on the positive legal norms. Distribution of goods and services in society have widened because of free trade, therefore,it causes trade market without borders. Trade of goods and services have been expanded so that they make the brand has a particularly important role in maintaining healthy competition.. In the trading of goods and services, the role of the owner as the party who has full rights to the brand product is to prevent violations of the brand. As example of violations that often occur among societies are counterfeiting of goods that increased causes public demand on counterfeit goods which has increased dramatically and then finally the distribution of its in society increased as well. Beside that, sociological factors, economic and culture that exist in society have contributed to the Distribution of counterfeit goods in society. As a result of this study, legal protection for brand owners to prevent the distribution of counterfeit goods has not yet fully done either by the brand owner itself or the government because various constraints. There are still rules of the brand has crime by accusation so it is only the brand owner who is active to prevent the distribution of counterfeit goods.
