Abstract

After the enactment of Government Regulation No. 61 Year 2014 on Reproductive Health that identifies the legalization of abortion in Indonesia in medical emergencies and Indications Indications Pregnancy due to rape is still a problem where there is still a practice of illegal abortions that are not in accordance with the rule of law. The practice of illegal abortions in the city of Yogyakarta is still going on, should the City Health Office Yogyakarta to perform its role and duties in order to solve problems that occur. The purpose of this study is to obtain the data and analyze the role of the Health Service in Poverty abortion rape victim is in conformity with the existing regulations and whether the role of the Department of Health in implementing the provisions of Law No. 39 of 2009 on Health have constraints in the prevention of abortion victims of rape. The method used by the Normative Legal Research ie legal description, systematization of law, legal analysis, interpretation of the law and assess the positive law. From interviews with law made by several speakers is a fact still the practice of illegal abortions in rape victims and the Health Department does not perform the role and duties in accordance with the rule of law, then the results of interviews law can be concluded that the Department of Health in running a role they have constraints, and they should develop a plan in order to solve the problems they have
