Abstract

Criminal violation not only conducts for civilians, it also done by Indonesian police officer. The issue arises as one of Indonesian police officer get involved in criminal violation and the investigator is Police Detective, which past of Police Depatment. This state will influence the objectivity of investigation which less serious in handling the case. Presents study proposes for identify the investigation over police officer as suspect such the objectivity and the obstacle during the investigation. The investigator is expected can be objective in performing their duties and responsibility for establishes justice stand on objectivity due to executed sanction by considering the violation severity. An appropriate sanction is equal to the violation degree which reveals through objective investigation. Thus, police investigators are responsible to maintain legal execution, justice, and protection over human dignity, legal orderliness and assurance. Therefore it is crucial for police investigators in work professionally in performing their duties and authority. Data analysis reveals that investigation over police officer as suspect is less objectives which it indicates discrimination during investigation due to detention. Detention on police officer who violates the law and civilian established in different prison. Therefore, it is important to stress the objectivity to establish justice and equality before the law principles.
