Abstract

Gender discrimination that occurs on the learners the woman, who was impregnated by a male learner in senior high school, basically not allowed or prohibited by any reason, which leads to loss of the right to access education by learners of women. Actually, the education rights protected in article 31 paragraph (1) of the Constitution of the Republic of Indonesia that is every citizen is entitled to education. The type of research that is done is the normatif legal research i.e. Research which focuses on positive form of legal norms and regulations. Types of data used include primary law, secondary legal materials and legal materials tertiary. In this case, will discuss about gender discrimination for female learners which expelled from the school because it was impregnated by male students, in senior high school, which in terms of the existence of a distinction between the right to education by gender men and women.
