Abstract

The title of this legal writing is sentencing toward the offender of forgery criminal act of document letter for publication land right certificate : a case study of judge’s sentence Number 482/Pid.B/2012/PN.Slmn. The criminal act of forgery arranged in 263 paragraph (1) of the Criminal Code is about 6 year penal sanction given to the offender of forgery. This research aims at knowing and analyzing method of sentencing toward the offender of forgery criminal act, especially in judge’s sentence Number 482/Pid.B/2012/PN.Slmn. This research was conducted through library research and by doing interview with the judge at Sleman District Court. The analysis indicated that in sentencing the offender of forgery criminal act, the judge considered yuridical, social and the living law factors. Besides, the judge also considered things that are heavy and light for the accused. Finally the judge sentenced 1 (one) year of imprisonment to the accused, which is just and fair for the parties involved in the case of forgery criminal act sentenced at Sleman District Court.
