Abstract

A healthy life is a right of every person including transvestites’ people (transgender). Generally, transvestites are susceptible to have narcotics problems. People who suffer this disease need to have medical rehabilitation and social rehabilitation. Indonesia submitted to double track system that it put rehabilitation as non penal sanction (treatment). There is a problem on giving the rehabilitation for transvestites : should we place them with men or women? This research aims to find the existence of the positive law that is regulating the placement for transvestites as narcotics addict, to find an information and to analyze the positive law about the lacement for transvestites as narcotics addict. The research method of this study is normative method which is focusing on the norms of positive law and literature study. The result of this research is that there is no positive law that is regulating the placement for transvestites as narcotics addict so there is no special treatment for them. The placement for transvestites as narcotics addict is in a accordance with the regulation of rehabilitation in general and it has special regulation when it is needed.
