Abstract

Human trafficking is a kind of slavery exist in modern era. Human trafficking becomes global business which gives a great amount of profit to human traffickers. About two millions people become the victims of human trafficking and most of them are women. The urge of economic problem becomes the major cause of these women to get lost in human trafficking. This research aims to figure out and analyze the practice of criminal sanction to the human trafficking criminal offender for the benefit of sexual exploitation under the verdict number 1.267/Pid.B/2010/PN.Bwi. The researcher conducts research in normative law: a research focuses on the norm of positive law in the form of legislations. In the Verdict Number 1.267/Pid.B/2010/PN.Bwi, Judge stipulates criminal sanction of 4 years imprisonment and Rp 120,000,000 fine of subsidiary of 3 months criminal imprisonment in substitution for fine, by considering the juridical and sociological factors. The juridical factors include the Indictment of Public Prosecutor, the legal suit of Public Prosecutor, the Defense of the Offender’s Attorney, and the criminal substances on Article 2 (1) under the Act Number 21 of 2007, meanwhile the sociological factors are any matters that may waive or testify the offender.
