Abstract

Thesis entitled Legal Responsibility of Notary in Fiduciary Guarantee Registration Electronically (Online System). Fiduciary guarantee registration office is Ministry Regional Office of Law and Human Rights is regulated on Act No.42 Year 1999 about Fiduciary Guarantee that serve registration manually. Circular Letter of the Director Gendral of Legal Administration No. AHU-06.OT.03.01 of 2013 on Enactment of Administration System of Fiduciary Guarantee Registration Electronically and Government Regulation No.21 Year 2015 that replace the Government Regulation No.86 of 2000 concerning Fiduciary Guarantee Registration Procedures and Cost of Deed Fiduciary Guarantee Publishing is issued. Since that registration of fiduciary guarantee is maked by online system. The type of the research of this thesis is a normative legal esearch. Administration by Electronic System bring about Notary legal responsibility of charging data fault. Based on this research , there are contractual legal responsibility between Notary and fiduciary registrant and non contractual legal responsibility because of the rights and obligations on acts about Notary, code ethics, decency, and the custom. Errors during data entry which Notary has been done can be raise lawsuit of tort or act against the law, that depens on kind of Notary legal responsibility which is violated.
